The satisfactory resolution of the daring, arrogant, brutal, cold-blooded and contemptuous gangland-style execution of Altantuya (blown up with C4 plastic explosives) on Malaysian soil is not merely a matter of justice being done. This one criminal affair puts on trial the entire Executive branch of government, judiciary, three successive IGP's and police, Attorney General, Ministry of Defence, Army and Navy, Public Accounts Committee and ruthless elements within the ruling Barisan National party.
More than anything else, it is a test of our resolve as conscientious citizens to force the government that we gave legitimacy to through the ballot box, to be accountable and transparent to us, and deliver justice as promised in our Constitution.
Ultimately, it is a test of our character as a nation. Can we allow murderers and their accomplices to get away scot-free because they have strong connections with the highest public office in our country? Can we allow Prime Ministers and IGP's with vested interests to obstruct and divert the true course of justice?
The fact that Altantuya's murder involved men and women very, very close to our Prime Minister Najib Tun Razak, who, together with his wife, has also been accused of being implicated in the murder by allegations made by at least two citizens, is like an episode from the 'Twilight Zone' TV Series of the '60's.
Frankly, after my last post on 30th July, I thought it would some time before I revisited the disturbing and premeditated gruesome murder of Altantuya. This is a homicide in which an Invisible Hand has been busy from the very beginning to subvert justice and ensure pro-establishment figures escape from the hangman's noose, while paid fall guys perform 'national duty'. How else can we explain the switching of judges, prosecutors and defence lawyers before a single scrap of evidence was tendered, or testimony, heard?
It has been clearly established in the novel 'Tiger Isle - A Government of Thieves' by E.S Shankar - CLICK HERE - that what we now have in Malaysia, is a classic case of a corrupt, organized mafia-style government of thieves, and now possibly, murderers, unwilling and unable to reform from within.
Ever since Mahathir laid down and perfected the foundation for the Ali Baba directly-negotiated and super-inflated government procurement contract, Malaysia has been going downhill at breakneck speed. It all began in 1998, when Mahathir and 'Diam, Diam' Daim conspired to directly award the $800 million North-South Highway contract to a company with little track record, in contravention of Treasury SOP. There were clear indications that the true owners of the company were nominees of UMNO. When challenged in court by Lim Kit Siang and DAP, the then already spineless Federal Court, headed by none other than the dubious Chief Justice Salleh Abas, ruled by a whisker (3-2 with Abas voting in favour), that breaking Treasury rules was all perfectly permissable, if done by the Prime Minister and a coterie of UMNO thieves.
Rumour hath it though, and not without some element of truth, that Mahathir (himself a self-confessed half-Indian) learnt it all from the infamous Samy Velu (of, if you see a snake and Samy, who should you strike first, fame) vis-a-vis the 1st Penang Bridge. This is of course in keeping with UMNO's scurrilous credo that it is always the fault of some Indian or Chinese should a Malay stray from the virtuous path of moral rectitude.
The in-built system of kickbacks to the ruling party has created an army of 24/7 day and night vampires (if only they all looked like Kirsten Stewart), whose uncouth culture of slurping and burping noisily while sucking the Rakyat's blood and spending it profligately in London, New York and Paris, had become an incurable addiction. Badawi and Najib were merely perpetuating an already tried, tested and proven system. After all, if Mahathir had condoned parasitical leechery as a cornerstone of the New Economic Policy (practised as a matter of national policy, even on their own people), oh great merciful and bountiful God, who were they to question it?
So, we come to our justices who, on appeal, yesterday set free Altantuya's killers. Whatever the mumbo-jumbo legalese, there is in the police files, a signed confession from Corporal Sirul detailing graphic details of Altantuya's killing. The High Court had incredibly ruled out this confession as inadmissable. CLICK HERE for Sirul's police statement.
Incredibly because:
1. Trial judge Mohd. Zaki expunged the confession on some technicality, even though Sirul had directed the police to the crime scene!
2. Altantuya was last seen leaving leaving the company of self-exiled (to Oxford, UK) Razak Baginda and the vicinity of his house, accompanied by not 1, not 2, but 3 Unit Tindakan Khas (Special Action Force) officers - Corporal Sirul Azahar Umar, Chief Inspector Azilah Hadri AND Azilah's long-time girlfriend, Lance Corporal Rohaniza Roslan.
3. Rohaniza contradicted several times in court her police statement, claiming she was "tortured" while in police custody and her life threatened by anonymous persons (from Mars). The prosecution filed for impeachment, but trial judge Zaki ruled that Rohaniza lied, but her testimony was credible. Huh? CLICK HERE and HERE.
Now where have we heard this kind contradictory logic before. Why, of course in the 2004 verdict written by two of three Federal Court judges in Anwar Ibrahim's Sodomy 1 appeal. There they wrote that they could not accept a word uttered by the unreliable accuser Azizan, but nevertheless they believed sodomy had taken place. They did not have the balls to convict Anwar, knowing it would be a travesty of justice, but played to Mahathir's gallery with screwed-up logic, and in the process, made themselves look like donkeys' ass!
The Court of Appeal seems to have completely ignored other evidence such as a blood stained slipper in Sirul's car and Altantuya's jewellery found in his apartment. During the trial, Sirul said he was “just a scapegoat who has to be
sacrificed to cover up the ill intentions of those who were not in
court.”
So, wither justice? Yes, the AG has appealed the Court of Appeals (CA) verdict. But, will the Federal Court deliver justice? I doubt it, not after the CA highlighted 10 "misdirections" by trial judge Zaki, while ignoring completely the direct evidence tendered.
This verdict is an insult to our intelligence and a slap in the face to justice.
If the justices had the slightest doubt, they should have ordered a mistrial. Especially, especially, especially, since for over 6 years, neither successive Inspector Generals of Police nor Prime Ministers, have given the orders to the police to answer that crucial question, which is the most damning indictment of our Government of Thieves, and possibly, murderers:
WHO GAVE THE ORDERS TO MURDER ALTANTUYA AND BLOW UP HER BODY TO BITS AND PIECES WITH C4 EXPLOSIVES?
NO ONE WAKES UP ONE MORNING AND SAYS "LET ME GO MURDER THAT BLACKMAILING BITCH AMINAH ALTANTUYA WHOM I HAVE NEVER MET AND KNOW NOTHING ABOUT!"
NO ONE GOES PREPARED TO KILL ARMED WITH GUNS AND C4 EXPLOSIVES, UNLESS THEY WERE FACILITATED BY PEOPLE IN HIGH PLACES, AND GIVEN THE ORDERS TO DO SO BEFOREHAND. THIS KILLING WAS PLANNED AND PREMEDITATED. OF THAT, THERE CAN BE NO DOUBT. A 12-YEAR OLD SCHOOLBOY CAN INFER CORRECTLY AS SUCH!
FIND THE REAL KILLERS AND YOU WILL FIND THE MOTIVE, WHICH TO-DATE HAS NOT BEEN ESTABLISHED. IT IS AN ADDITIONAL INSULT TO THE RAKYAT'S INTELLIGENCE BY OUR JUDGES AND PUBLIC PROSECUTORS TO SAY THAT THE MOTIVE FOR THIS MURDER IS NOT IMPORTANT.
THERE WERE 7.3 BILLION CORRUPT REASONS FOR A MURDER MOTIVE!!

Everyone knows including the Judges that Sirul and Azila murdered altantuya. Who gave the order is anybody's guess.
To acquit the killers because of some technicalities is pure nonsensical. Both killers were the last persons to be seen with Altantuya. And they found Altantuya's jewellery in the possession of Sirul. The least these (un)learned Judges could do is to declare a mistrial and order a trial.
Why...even Sirul's lawyer are arguing for a mistrial. Quite dishonorable judgement, I would say.

But perhaps, the silver lining is that a RCI may follow.
As long as we don't have the determination to find the truth, we have chosen to be fooled by the illusions that has been magically spun.We the public must act. The question is how.

Everyone who cares, and the stakes are high, must lobby his local MP and Party leaders and keep pressuring the AG, Chief Justice and Najib.
Sooner or later, the dam must and will break!
To be fair to those (dis)honorable 3 Crt of Appeal Judges,ie Apandi, Linton and Maimoon, they were not criminal lawyers and had never been deputy public prosecutors bf becoming Judges. That is why the Judgment lacked logic and commonsense.
Why in the first place they empanelled these three ex-civil/commercial lawyers to hear a very important criminal appeal is anybody's guess. There are a few Crt of Appeal Judges who are very experienced in hearing criminal appeals having been criminal lawyers or dep.public prosecutors. Why were they not asked to hear the appeal.
Just ask the three how many criminal cases that they had handled bf being Judges. Then you can understand the weird and illogical judgment.
Who knows whether they know what a re-trial is or whether it could be ordered,

I think the AG, the CJ and Najib are all playing a dangerous game. Right from the beginning the judges and prosecutors seem to have been compromised.
We must fight on regardless.

A closer look( you don't even have to scrutinize) at the written( if any)judgement by all our CA or FC, it makes one wonder whether we have only robots(?)/ humanoid(?) sitting on the Bench. There are only interested in TECHNICALITIES to throw out whatever cases before them. Justice? That will be the last in their mind.
There is the "appeal" to come but why do I feel that I already know the outcome ?
Perhaps the AG's Office should take up the DAP Legal Bureau's offer to outsource to them ? Its already being done to the Sodomy II appeal.
Disbelief is a mild reaction but my sympathies to the family of the deceased. They are the ones who are living the nightmare.
I hope the civil suit starts soon.
DPP: I agree that the trial convicting the two Tindakan Khas fellas (FACES COVERED THROUGHTOUT THE TRIAL -- WHY?) should have been dismissed as a MISTRIAL and a new trial under a new judge should be conducted.
I would suggest that this time the charges be amended:
1. Razak Baginda should be the principal to be charged for the murder of Altantuya as he had obvious motive (:Mens rea" -- a key ingredient to prove any criminal offence...)
2. The two accused just set free by Appeals Court should be charged as "accomplices" to murder as they clearly were just accrying out orders (to kill the Mongolian beauty) ON INSTRUCTION FROM SUPERIOR OFFICERS.
3. The key Q is WHO ARE THE SUPERIOR OFFICERS, and were they also taking instructions fro people in the PM's Depart?

As one read the written judgment of the CA, we noticed more stupidity coming from the Judges.
On the night Altantuya was murdered, it was found as a fact by the Judges that the two accused had arrested Altantuya at Razaak's house and taken to Bukit Aman where she is seen being taken away from there in the 2nd accused car, which was obviously driven by the 2nd accused. There was no evidence that Altantuya was released or being handed over by the two accused to other police officers. That was the last time altanuya was seen alive. Her body ws never found until, the 2nd accused led police to the area where Altanuya's body was detonated. DNA result confirmed it was Altantuya's body.
The Judges said, the 2nd accused might be framed...when at all material times since her 'kidnap' at Raszak's house, she was under the custody and control of both accused.
Anybody intelligent than the Judges care to explain.
"...the dubious Chief Justice Salleh Abas" in retrospect now looks like a paragon of legal virtue.
